This section defines the ownership, confidentiality, and usage rights governing all materials, data, and intellectual property related to Questut. By accessing or using Questut, you agree to comply with the following legal terms.
1. Ownership of Content
- All original materials — including but not limited to online courses, printed materials, brochures, books, manuals, guides, flyers, videos, audio content, graphics, course structures, and all associated resources — are the exclusive property of Questut.
- Copying, reproducing, distributing, republishing, scanning, downloading, modifying, or reprinting any Questut material, whether digital or printed, without prior written consent is strictly prohibited.
- Unauthorized resale, duplication, or redistribution of Questut’s educational materials will result in immediate legal action and may include claims for damages.
2. Third-Party Educational Content
- Questut may use or license educational materials from recognized international or local institutions for training and academic purposes.
- All intellectual property rights of such materials remain the sole property of their original owners.
- Questut respects and acknowledges these rights and uses such materials under valid permissions, licenses, or applicable fair use principles.
- Users, trainers, and partners are prohibited from reproducing or distributing any third-party materials outside Questut’s authorized use.
3. Trademark Rights
- The name “Questut” “كويستوت”, the slogan “Learn. Grow. Excel.” “تعلّم. تطوّر. تميّز.”, and all associated logos, icons, and trade dress are registered trademarks owned and protected by Questut.
- Unauthorized or misleading use of Questut’s branding, name, or visual identity for any purpose—including commercial advertising, promotion, or endorsement—is strictly forbidden.
- Written authorization from Questut is required for any marketing or co-branding activity involving Questut’s brand identity.
4. Permitted Use
- Users are granted limited access to Questut’s content strictly for personal and educational use.
- Commercial use, resale, sublicensing, or sharing with third parties without explicit written permission is prohibited.
- Any misuse, including unauthorized reproduction or redistribution, may result in account termination and legal proceedings.
5. Trainer & Contributor Rights
- Any trainer, instructor, or contributor collaborating with Questut hereby irrevocably assigns all intellectual property rights related to the content, course materials, printed guides, slides, images, video recordings, and any related resources created during the collaboration.
- Questut shall be the sole and exclusive owner of all such materials, with full rights to reproduce, edit, adapt, distribute, publish, market, or resell the course content in any medium.
- Trainers are strictly prohibited from offering, promoting, or selling their own services or training directly or indirectly to Questut’s trainees during or after the course, whether online or offline.
- Trainers must not contact Questut trainees for personal marketing, competing services, or solicitation of any kind.
- Use of Questut’s name, courses, or association to market independent offerings is strictly prohibited.
- Any exception to ownership or usage rights must be explicitly stated in a written agreement signed by both parties.
- Any educational or training materials, in any form or format, to which the trainer gains access or possession by virtue of their engagement with Questut - including but not limited to course content, manuals, slides, printed or digital resources, proprietary documents, or third-party licensed materials - shall remain the exclusive property of Questut.
- The trainer is strictly prohibited from reproducing, reselling, disclosing, sharing, giving away, or otherwise using such materials for personal, commercial, or competitive purposes outside the scope of their engagement with Questut, whether during or after the term of the contract.
- This prohibition applies regardless of whether the materials are originally owned by Questut or licensed from a third party, as long as the trainer obtained access to them through their role with Questut.
- Violation of any provision in this section will result in immediate termination of collaboration and may lead to legal and financial liability under applicable laws.
6. Joint Courses with Partner Institutes
- For joint training programs or collaborative courses conducted with local or international institutes, whether online or in person, Questut shall remain the exclusive and perpetual owner of all related intellectual property and materials.
- The partner institute or collaborating entity shall not:
- Sell, resell, sublicense, or reproduce the course materials or any portion thereof.
- Contact Questut’s trainees directly or indirectly for marketing, sales, or recruitment purposes.
- Use or disclose Questut’s trainees’ data, or attempt to solicit Questut trainers, employees, or contractors for employment or freelance work.
- Engage in any communication that misleads trainees into believing they are dealing directly with Questut after contract termination.
- All trainees and trainer information shared during cooperation is considered confidential and may only be used within the agreed training scope.
- Any attempt to recruit or engage Questut’s trainers, trainees, or staff outside the collaboration is strictly prohibited and constitutes a material breach of contract.
- Upon expiration or termination of the agreement, all rights, including course materials, recorded sessions, and student data, remain vested exclusively in Questut.
7. Confidentiality & Non-Disclosure
- All trainers, employees, contractors, and partner institutes must maintain strict confidentiality regarding Questut’s non-public information, including but not limited to:
- Trainees data, personal information, and contact details.
- Course content, marketing materials, business operations, pricing structures, and internal communications.
- It is strictly forbidden to:
- Contact trainees directly during or after a course for any personal, commercial, or competing purpose.
- Sell, share, or transfer trainees’ data or use it for marketing or promotional activities unrelated to Questut.
- Use Questut’s platform or affiliation to solicit trainees for independent courses or external services.
- Any breach of confidentiality or misuse of trainees’ data shall result in legal liability, financial compensation, and may lead to criminal prosecution under applicable data protection laws.
8. Derivative Works & Course Modifications
- Any adaptation, translation, enhancement, printed publication, or derivative version of Questut’s courses or materials shall be deemed the exclusive property of Questut.
- No partner, trainer, or third party may develop or market derivative courses or related printed materials without written authorization.
- Unauthorized modification or repurposing of Questut’s content, whether digital or physical, constitutes infringement and will be subject to legal action.
